Can I evict a tenant without going to court?
No. In South Africa, all evictions must be authorised by a court order. Any attempt to remove a tenant or their belongings without due process is a criminal offense and will likely result in a court ordering you to reinstate the tenant.
Can I change the locks or disconnect utilities?
Strictly no. This constitutes “unlawful self-help”. The tenant can urgently apply for a spoliation order, forcing you to restore access and potentially pay their legal costs.
How long does an eviction take?
An unopposed eviction typically takes three to five months. If the matter is opposed, it can take longer depending on the court’s availability and the complexity of the defence. This is why procedural momentum is our top priority.
What happens if the tenant damages the property?
You have the right to claim for damages. We assist in quantifying these losses and pursuing the tenant for recovery through separate litigation if necessary.
