Divorce Settlements That Stand the Test of Time
A divorce settlement must work in practice, not just on paper. Poorly defined agreements are the leading cause of post-divorce litigation. We focus on getting the details right from the outset so that your outcome remains stable and your interests remain protected.
We assist in structuring comprehensive agreements regarding:
-
The Accrual System: Precise calculation of estate growth to ensure fair division.
-
Parenting Plans: Detailed care and contact arrangements that prioritise the child’s best interests.
-
Spousal & Child Maintenance: Financial support structures based on realistic needs and verified income.
-
Rule 43 Applications: Securing interim maintenance and care orders while a divorce is finalised.
A Structured Approach
to Family Law
Family disputes are inherently personal, but they require a professional, structured framework to resolve. Our approach in the Northern Suburbs focuses on:
-
Clear Legal Positioning: Knowing exactly where you stand before negotiations begin.
-
Structured Negotiation: Moving toward a settlement without unnecessary emotional or financial cost.
-
High Court Formalisation: Ensuring every agreement is made an Order of Court for maximum enforceability.
-
Risk Mitigation: Identifying potential "loophole" areas in asset division or parenting schedules.

Questions
How is accrual calculated in a divorce?
If you are married “Out of Community of Property with the Accrual System,” the growth of each spouse’s estate is calculated from the date of marriage to the date of divorce. The spouse whose estate has grown less is entitled to half the difference of the larger growth, excluding inheritances or personal injury payouts.
What can I do if my ex-partner stops paying maintenance?
Maintenance orders are legally binding. We can assist with enforcement through the Maintenance Court, including garnishee orders on salaries or execution against movable assets to settle arrears.
Can an existing parenting plan be changed?
Yes. If there is a material change in circumstances, such as a relocation or a change in the child’s needs, a parenting plan can be amended, provided the change is in the best interests of the child.
How long does an uncontested divorce take in Cape Town?
An uncontested divorce can often be finalised within a few months, depending on the court roll. Contested matters take significantly longer, often requiring interim “Rule 43” orders to manage finances and children in the meantime.
