Strategic Civil &
Commercial Litigation
We assist clients in resolving high-stakes disputes where informal engagement has failed. This includes breached agreements, shareholder conflicts, and unpaid obligations. When a matter cannot be resolved through discussion, a structured legal approach is required to protect your position and move the matter forward.
Our role is to take control of the process, apply a precise legal strategy, and drive the matter toward a definitive resolution in the Magistratesâ or High Court.
Why Timing Matters
in Disputes
In South African law, under the Prescription Act, most contractual claims must be enforced within three years, or they are lost entirely.
Unresolved disputes begin to stall decision making and day-to-day operations. Taking early legal advice allows you to intercept these risks, meet procedural deadlines, and approach the matter from a position of strength rather than a reactive defence.
A Result-Driven Approach
to Litigation
We approach litigation as a structured process focused on a clear financial or operational outcome. We assess your position in practical terms, determining the most efficient path to resolution.
Our framework includes:
-
Defining the Appropriate Legal Strategy: Identifying the core leverage points in your favour.
-
Selecting the Correct Forum: Determining whether the matter belongs in the Magistrateâs Court, High Court, or specialised tribunal.
-
Drafting Enforceable Pleadings: Ensuring your case is technically sound from the first filing.
-
Maintaining Procedural Momentum: Using court rules to prevent the opposition from causing unnecessary delays.

Questions
Can I recover my legal costs?
In most South African courts, the successful party is awarded costs. However, these are usually awarded on a “party-and-party” court scale, which may not cover your full expenditure. We factor cost-recovery potential into our initial strategy.
What is âprescriptionâ and how does it affect me?
Prescription is the legal “expiration date” of a claim. For most commercial matters, this is three years. If you do not serve a summons within this window, your claim may be legally unenforceable.
How do I know if my matter is worth pursuing?
This depends on the strength of the claim, the value involved, and the likelihood of recovery. We assess both legal merit and practical viability before proceeding.
Do I have to go to court?
Not always. Many matters are resolved before trial. However, preparing a matter properly for court often creates the pressure needed to achieve a settlement.
